01 / Membership Standards

A small group of firms, chosen for quality.

Membership criteria are written. They are applied uniformly. They are not negotiated. The four standards below describe the firm — not any particular attorney — and govern admission as well as continued membership. Every applicant is reviewed against every criterion.

01 / TECHNICAL CREDENTIALS

Genuine technical depth, validated.

The firm must be able to staff matters in at least four of the thirteen recognized technology areas with attorneys whose training and experience demonstrably support that classification.
  • Verified undergraduate or graduate degrees in the relevant discipline
  • USPTO registration for prosecuting attorneys and agents
  • Prior industry or research experience preferred above coursework alone
02 / PROFESSIONAL STANDING

A clean, verifiable record.

Every applicant firm is reviewed for disciplinary history at the state bar level and at the USPTO. Adverse findings are not automatically disqualifying, but are weighted heavily and reviewed individually.
  • State bar good standing across all attorney admissions
  • OED search for each USPTO-registered practitioner
  • Malpractice carrier confirmation at minimum coverage levels
03 / QUALITY OF PRACTICE

Evidence of substantive prosecution work.

The firm must demonstrate a sustained record of patent prosecution — not occasional filings appended to a litigation or transactional practice. Allowance rates, RCE incidence, and claim quality are reviewed against USPTO data.
  • Minimum five years of continuous prosecution practice
  • Independent claim quality benchmarked against examiner-level data
  • Sample office-action responses reviewed by Tradespace counsel
04 / OPERATIONAL FIT

Capacity, responsiveness, and ethics.

Member firms must operate at a service level that meets the expectations of corporate IP teams: predictable turnaround, transparent billing, structured docketing, and the ability to clear conflicts on a per-matter basis without delay.
